Amount of the Staged Premiums
Premiums are calculated using the methodology approved by the courts (such as the Court of Appeal in Rogers v Merthyr Tydfil CBC).
Premium (i) will be significantly cheaper than a premium for stage (iii) as the costs involved and, therefore, the actual exposure to an ATE insurer increases as a case progresses to trial.
Premiums are individually assessed for one-off policies or when top-up cover is sought.
We can cater for high limits of indemnity and cases insured post-issue.
Amount of the Staged Premiums
If QBE’s premium is challenged then we will become involved in supporting the recovery of the full premium. We will work with your solicitors in dealing with any challenge.
Give the decision of the Court of Appeal in the case of Rogers v Merthyr Tydfil CBC, we are confident that a full recovery will be made.
Security for Costs
In the event that an opponent makes an application for security for costs, our ATE insurance policy may be adequate security, if it is already in place by the time that the application is threatened.
In any event, QBE is able to issue a bond (i.e. a deed of indemnity) to dispose of any security for costs application (or threatened application).
The bond can be issued for a value of up to the limit of indemnity under QBE’s ATE policy.
