Known Risk Policy
Title Insurance for a wide range of problems from missing deeds and lack of building regulations, through to breaches of restrictive covenants.
Good Title Policy
Enhanced Title Insurance for known risks, as well as a range of potential problems that may not be identified at the time of conveyancing such as unknown illegal building works.
What Risks are Covered?
Local Authority, Water or Drainage and Coal Search
Title Insurance covers your clients when a formal search of Land Authority Charges, Water Service Company and Coal Authority registers has not been applied for, is outdated, or is delayed.
Missing or Defective Leases or Deeds
Your clients are covered in the event of a lease or deed being missing, or containing inadequate provisions and information. An example of this is inadequate provision as to repair and maintenance of the property, or when there are restrictive covenants but these are unknown.
Building Location Issues
Cover is provided for many issues regarding the property’s location. For example if the property is built over a public sewer, whether the property is subject to Chancel repair, whether parts of the property extend above or below another property or if the building lies over an existing right of way. Clients are also covered when the property is subject to a reserved right to mine.
Property Works Needed
Title Insurance offers cover where the property has a lack rights of access for pedestrians and vehicles, and when there are no, or inadequate rights of drainage, service media or water supply.
Lack of Permission or Consent for Alterations
Cover when alterations have been made without planning permission, the relevant building consent, or where covenants restricting land use have been breached.
Ownership
Title Insurance covers several issues that arise out of ownership matters. For example when no landlord can be identified, when lease validity is challenged, in the case of transfer of land as a Gift or when the owner of reversionary interest attempts to take back land.
Excess Charges
There may be extra charges associated with the property, such as an outstanding Land Charges Entry or a third party periodic rent charge noted on the title deeds.
