Title Insurance responds to the issues created by defective title in a number of ways, including:
- Covering the cost of responding to a challenge over the insured’s right to use the property.
- Covering the cost of pro-active steps to rectify a challenge, including legal fees.
- Indemnifying the insured against a loss such as losing ownership of the property or not being able to use the property in the way they envisaged.
The Policies
PYV deals with two different policies of Commercial Title Insurance:
Development Property:
This is defined as a property which is going to be developed, or may be changing from its originally intended usage. PYV can offer indemnity up to £15 million.
PYV provides access to a wide range of potential title risks online: Adverse possession, Flying/Creeping Freehold, Lack of Easement (Pedestrian Access, Services/Drainage, Vehicular Access), Local Authority Search- Search Validation for Purchase Transactions, Restrictive Covenant- Existing Breach of Known Freehold Restrictive Covenants, Restrictive Covenant- Unknown Freehold Restrictive Covenant, Chancel Repair, Title Registered at Land Registry with Good Leasehold, Title Registered at Land Registry with Possessory Title, Title Subject to Rights of Way/ Rights of Service Media/ Rights of Drainage in a Deed/ Conveyance/ Transfer and Title Subject to Unknown Exceptions and Reservations.
Continued Use Property:
This cover relates to property which will remain as a commercial concern, and the usage will not change. PYV can offer indemnity up to £5 million.
